01 | Objectives of Personal Data Processing
The Ferrari Club Belgio (FCB) and all companies within its group are highly committed to respecting your personal data and protecting your privacy. The FCB aims to inform you, respect your rights, and allow you to control the use of your personal data, as stipulated by the European Regulation 2016/679 of 27/04/2016 regarding the protection of individuals concerning the processing of personal data and the free movement of such data, known as GDPR, General Data Protection Regulation (hereinafter the “Regulation”). Whether you are a member, licensee, customer, co-contractor, and/or visitor to our websites and/or user of our applications, this privacy protection policy (hereinafter, the “Privacy Policy”) aims to clearly inform you about how your personal data is collected and processed by the FCB and the means you have to control this use. You express your consent to this Policy, notably by expressly checking a box provided for this purpose when continuing to visit our site or using certain services. While you are not obligated to provide your data to the FCB or accept their processing, some communications are necessary, particularly to enable the execution of a contract and/or compliance with current legislation. Changes may be made to the Policy at any time. It also applies to the collection, management, and use of your data by other entities affiliated with the FCB, without prejudice to additional conditions applicable to specific services or applications. 02 | Scope of Application
This Privacy Policy sets out the principles and guidelines for the protection of your personal data, collected during your visit to this site and/or in the context of our sports, contractual, or commercial relationships. The term “personal data” (hereinafter “Personal Data” or “Data”) refers to any information relating to an identified or identifiable natural person. A person is “identifiable” as soon as he or she can be identified directly or indirectly, in particular by reference to one or more elements specific to him or her. This Privacy Policy applies only in the context of our relationships with natural persons. In the case of legal entities, this Policy is valid only for personal data relating to natural persons representing or acting as representatives of the legal entity (such as agents, representatives, or any other contact person). In contrast, “non-personal data” refers to information that does not allow the identification of a natural person.

04 | Nature of Processed Personal Data
The FCB collects the following personal data: data that you voluntarily provide to us: following your affiliation, subscribing to our services, placing an order, subscribing to a newsletter, creating a user account, making complaints, or simply voluntarily; these data may be identification and contact information (e.g., name, first name, address and locality, email address, phone or GSM number, date of birth, age, gender, language, chassis number of your Ferrari and model, etc.), professional (e.g., company number/VAT, profession, name, and function in the company, etc.), financial or billing (e.g., bank account number, BIC code, account holder’s name, billing/delivery address), technical (e.g., username, password, security questions, login times, IP address, location, etc.), related to your purchasing behavior (e.g., favorite products or services, preferences and interests, past purchases, etc.), or various (e.g., remarks, suggestions, testimonials, and any other forms of feedback, text, images, curriculum vitae, etc.); data from the use of our websites, applications, and other online services (especially using cookies – see below): pages, websites, and applications visited or used, searches and data entered on them or to which the FCB may access (e.g., IP address, location, date and time of consultation, etc.); data from third parties: following their purchase or rental from specialized suppliers in this activity, following agreements with partners, data from publicly accessible sources and/or available on social networks or others, under the conditions and restrictions applicable to data held by these suppliers, data that are generally of the same nature as those specified above or constitute an update. Your personal data is not stored longer than necessary to achieve the purposes stated in this Policy, and the duration may vary depending on the data/purposes concerned.

05 | Purpose of Personal Data Processing
The FCB will only collect and process your data after obtaining your consent or on a valid legal basis, such as the performance of a legal obligation, the performance or request of a contract, or on the legitimate interest of the FCB or a third party, in order to meet the following purposes: The provision of services or products, contract and customer management, namely their administration, including tax and accounting aspects, monitoring and execution of orders, issuing and possible recovery of contributions or other claims, monitoring solvency and recovery, with or without the assistance of third parties; Information about products and services offered by the FCB; Prospecting, such as advertising and direct marketing, including sending advertisements, newsletters, and information, invitations, in a targeted and/or non-targeted manner, by electronic, SMS, social media, and/or postal means, both on the activities, offers, promotions, and/or activities of the FCB, with your consent and/or in the legitimate interest of the FCB to promote its services to its members, affiliates, and customers; Communication of promotional offers from the FCB or its partners and offers to participate in contests; Conducting satisfaction surveys and market research, statistics, maintenance, and continuous improvement of our products, services, websites, and applications (mobile), as well as personalization, user profile creation, optimization of general, commercial, and marketing strategies of the FCB and its partners, including the creation and management of user accounts, loyalty programs, targeted promotions, and others; Verification of the minimum age for certain services; Optimization of our services and products, websites, and other applications; Security of our services and products, websites, and other applications; Compliance with any applicable legislation.

06 | Persons Accessing the Collected Personal Data
The FCB normally does not share your data with third parties, except for the following exceptions: with companies that are part of the same group and are therefore linked to it, a list of these companies can be obtained on request, these using your data for the same purposes as described above; with subcontractors who process data on behalf and on behalf of the FCB (or a group company), who act under its responsibility and according to its instructions (such as a database manager, advertising agency, or any other provider); our subcontractors provide all sufficient guarantees regarding the implementation of appropriate technical and organizational measures so that the processing meets the requirements of the law and guarantees the protection of the rights of the data subject. if you have given us your prior and express consent; in cases determined by law, following an obligation under a regulatory or legal procedure, or at the request of legislative or judicial authorities. 07 | Security of Personal Data
The personal data that you expressly or automatically provide to us is stored in the FCB’s files. The FCB takes all necessary administrative, technical, and organizational measures to protect your data against destruction, loss, unintentional modification, damage, accidental or unauthorized access, or any other unauthorized processing of this data. For the performance of certain tasks, the FCB calls on other companies (e.g., technical maintenance of our websites, etc.). These companies will only have access to your personal data to the extent necessary for their intervention. The number of employees or collaborators with access to your personal information is limited, and access is only granted to the extent necessary for the performance of their functions.

08 | Use of Cookies
The FCB uses cookies to collect information for improving website navigation or the use of mobile applications and to provide commercial or marketing information to its owner. The FCB will in no way be responsible for the content or practices of the owner or operator of these sites.

10 | Your Rights Regarding the Personal Data We Collect
Your personal data is always processed in accordance with the legitimate purposes set out above. They are collected and processed appropriately, relevantly, and not excessively and are not stored longer than necessary to achieve the purposes pursued.

10.1. Right to Object to Use for Prospecting
You can at any time object, without reason, in whole or in part, to the use by the FCB of your data for prospecting purposes (direct marketing), including related profiling. You can do this by:

  • Online, via your user account, or at the bottom of the commercial notifications sent to you, by clicking on the “unsubscribe” link and/or modifying your “preferences”. You can also contact the data processing officer directly (see contact details above).

10.2. Right of Access to Your Data
If you can prove your identity, you have the right to obtain information about the processing of your data. Thus, you have the right to know the purposes of the processing, the categories of data concerned, the categories of recipients to whom the data is transmitted, the criteria used to determine the duration of data retention, and the rights you can exercise on your data.

10.3. Right to Rectification
Inaccurate or incomplete personal data can be corrected, either through your user account by making the necessary changes yourself or by contacting the data processing officer directly (see contact details above).

10.4. Right to Erasure (or “Right to Be Forgotten”)
You have the right to obtain the erasure of your personal data in the following cases, namely if: (a) your personal data is no longer necessary for the purposes, (b) you withdraw your consent to processing and there is no other legal basis for processing, (c) you have validly exercised your right to object, (d) your data has been unlawfully processed, (e) your data must be deleted to comply with a legal obligation. The FCB determines on its own whether the criteria mentioned above exist.

10.5. Right to Restriction of Processing
In certain cases, you have the right to request the restriction of the processing of your personal data, particularly in case of dispute about the accuracy of the data, if your data has been processed unlawfully, if the data is necessary for a legal proceeding, or the time necessary for the FCB to verify that you can validly exercise your right to erasure.

10.6. Right to Object
You have the right to object at any time to the processing of your personal data. The FCB will then cease processing your personal data unless it demonstrates that there are compelling legitimate reasons for the processing that override your right to object.

10.7. Right to Data Portability
You have the right to obtain all personal data you have provided to us in a structured, commonly used, and machine-readable format. Upon request, this data can be transferred to another provider, unless it is technically impossible.

10.8. Right to Withdraw Your Consent
You can withdraw your consent to the processing of your personal data at any time. The withdrawal of your consent does not affect the validity of processing operations prior to withdrawal.

10.9. How to Exercise Your Rights
To exercise your rights, you must send a request to the data controller, namely the ASBL FCB, by postal mail [Rue Edith Cavell 66, 1180 Brussels] and/or by email [president@ferrariclubbelgio.com], accompanied, if necessary, by proof of your identity. A response will be provided as soon as possible, and at the latest one (1) month after receipt of the request.

10.10. Possibility to File a Complaint
If you are not satisfied with the processing of your personal data by the FCB, you have the right to file a complaint with the Data Protection Authority from June 30, 2018 (https://www.privacycommission.be).
